2. Use License

You are granted a limited, non-transferable license to access and use Tub Careers content for personal, non-commercial, educational purposes only. You may not:

  • Share, redistribute, or publicly display course materials
  • Download or screen record course videos
  • Modify, resell, or create derivative works based on the course content
  • Use or access our platform through automated means (e.g., bots, scrapers)

This license automatically terminates if you breach these terms and may be revoked at any time.

4. Account Registration and Account Security

To access course materials, you must create an account and provide accurate, current information including your name, email address, and payment details. You are responsible for maintaining the confidentiality of your login credentials. Tub Careers is not responsible for account misuse.

5. Course Access and Payment

Access to our courses requires payment through approved payment processors. By purchasing, you agree:

  • All payments are final and non-refundable unless otherwise stated
  • Your access is limited to the course(s) or membership(s) you’ve purchased
  • Sharing your account with others is strictly prohibited

6. Refunds and Cancellations

All purchases made on Tub Careers are final and non-refundable unless otherwise stated in writing at the time of purchase.

Because you receive immediate access to proprietary course content, digital materials, and downloadable resources upon enrollment, we do not offer refunds for:

  • Course fees
  • Membership plans
  • Subscription payments
  • Any downloadable digital products

In rare cases, refund exceptions may be made at our sole discretion for duplicate charges or technical issues preventing access, provided you notify us within 7 calendar days of your purchase at [Insert Support Email].

By purchasing any course or subscription, you acknowledge and agree to this refund policy.

If your course or membership includes recurring payments (e.g., monthly access), you may cancel future charges at any time via your account settings. However, previous charges will not be refunded, and you will retain access until the end of the billing cycle you’ve paid for.

7. Prohibited Activities

You agree not to use the Tub Careers platform, content, or services for any unlawful, unauthorized, or prohibited purpose. Without limiting the generality of the foregoing, you specifically agree that you shall not:

  • Attempt to bypass access restrictions, content protections, or membership rules, including use of bots, scraping tools, or similar methods.
  • Upload or transmit any malware, viruses, or harmful code that could disrupt the platform or interfere with other users’ access.
  • Use the platform in violation of any applicable law or regulation, including those governing online education, privacy, and intellectual property.
  • Engage in harassment, abuse, or disruption of the learning experience for others through forums, support channels, or direct communication.

Violations of these rules may result in the immediate suspension or termination of your account, forfeiture of any course fees paid, and potential legal action to recover damages or seek injunctive relief.

18. Changes to the Terms

We may update these Terms from time to time. Continued use of the site after changes constitutes acceptance of the new Terms.

19. Governing Law

These Terms are governed by the laws of the State of Virginia without regard to conflict of law principles.

20. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to your use of Tub Careers, the content or services provided, or these Terms of Use, the parties agree to resolve the matter exclusively through binding arbitration rather than in court.

a) Binding Arbitration

You agree that all disputes shall be resolved by a neutral arbitrator under the rules of the American Arbitration Association (AAA) or another mutually agreed-upon forum. You expressly waive your right to bring any legal action in a court of law or to have any dispute decided by a judge or jury.

b) Individual Resolution

You and Tub Careers agree to resolve disputes only on an individual basis. You hereby waive any right to:

  • Participate in a class action lawsuit or class-wide arbitration
  • Bring any claim as a plaintiff or class member in a representative proceeding

c) Pre-Arbitration Resolution

Before initiating arbitration, either party agrees to attempt in good faith to resolve the dispute informally by notifying the other party in writing and allowing up to 30 calendar days for a response.

d) Exceptions

Nothing in this section prevents either party from seeking:

  • Temporary or preliminary injunctive relief in a court of law to prevent actual or threatened misuse of intellectual property or confidential information
  • Relief in small claims court for qualifying disputes

e) Governing Law & Venue

This agreement to arbitrate shall be governed by the Federal Arbitration Act and the laws of the State of Virginia, without regard to its conflict of law principles.

Arbitration Agreement

This Arbitration Agreement is a part of and subject to the Terms of Use for Tub Careers.

By agreeing to these Terms of Use and using Tub Careers’ services, you and Tub Careers agree that any and all past, present, and future disputes, claims, or causes of action arising out of or relating to:

  • These Terms
  • Your use of the Tub Careers website(s)
  • Access to any course, product, or service provided
  • Any advertising, marketing, or communications related to Tub Careers

shall be resolved exclusively and finally through binding arbitration, rather than in court, except as expressly provided otherwise in the Terms.

a) Waiver of Jury Trial and Class Actions

By entering into this agreement, you and Tub Careers expressly waive the right to a trial by jury or to participate in any form of class, collective, or representative action or proceeding. All arbitration must be conducted on an individual basis only.

b) Governing Rules

The arbitration shall be administered by the American Arbitration Association (AAA) and conducted in accordance with the AAA’s Consumer Arbitration Rules then in effect, except as modified by this agreement.

c) Location of Arbitration

Unless both parties agree otherwise, the arbitration will take place in a mutually convenient location or via remote methods (teleconference or video conference).

d) Arbitrator’s Authority

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this agreement to arbitrate. The arbitrator shall have the authority to grant any relief that would be available in a court of law.

e) Fees

Each party shall bear their own costs and attorney’s fees, except where applicable law or the arbitrator awards legal costs to the prevailing party.

f) Enforceability

If any part of this Arbitration Agreement is found to be unenforceable, that portion shall be severed, and the remainder of the agreement shall remain in full force and effect. If the class action waiver is found to be unenforceable, the entirety of this Arbitration Agreement shall be null and void.
